Client Disclosure and Consent Notice — Schedule 2 to the Referral Partner Agreement


How to use this — for the Partner, not part of the notice

Read this page before you use the form below. The form itself starts at the horizontal rule.

  1. Give the notice to your client before you introduce them, not after they have subscribed. That timing is not our preference — it is what CIOT/ATT PRPG 8.3.1 requires ("no later than at the time the advice is given"), and it is what Hopcraft v Close Brothers [2025] UKSC 33 requires ("before contract formation"). Doing it before also happens to be the only model that works for an ICAEW firm, because otherwise the commission is client money and has to sit in a client account until consent arrives. Nobody wants to run a client account for £2.40 a month.
  1. Fill in the blanks before you send it. The practice name, the reason you are recommending Pocket Docket, and the date. The reason matters: PRPG 8.3.2 requires you to be able to justify the advice by reasons other than the receipt of the commission. Write a real one.
  1. Keep the signed copy for at least six years and send a copy, or a signed confirmation, to contracts@pocketdocket.co.uk. We will not pay commission on any client for whom we do not hold that record — and if we ask you to produce it, you have ten business days.
  1. Do not edit the substance. You may reformat it onto your own letterhead and you may add to it. You may not take anything out. If you use a materially different form, it must give the client no less information than this one does, and the risk of a shortfall sits with you under the agreement.
  1. The second tick box is optional and is only for one situation — where you intend to send us your client's contact details yourself. If your client is coming to us with your referral link (which is what we prefer, and what we ask for), you do not need it and you should delete it.
  1. We will also ask your client. At signup we ask every customer who arrived with a referral code to confirm they were told about the commission. That is not a check on your honesty. It is there because the law makes us liable to your client if consent was not properly obtained, and it protects both of us.

If Pocket Docket's price changes, the commission stays at 10% of what you actually pay, so the cash amount would change with it. We will tell you if that happens.

What this means for you, plainly

You do not have to use Pocket Docket. You are free to choose a different product, or none. Our advice to you, and our fees, are not affected either way.

We would recommend this product regardless of the commission, and if you would like us to explain why without reference to it, ask and we will.

If you would rather we did not keep the commission, say so. We will either credit it against your fees or decline it altogether — whichever you prefer. It is your call and there is no awkwardness in making it. Just tick the second box below, or tell us.

We have no other financial interest in Pocket Docket — no shareholding, no directorship, no other arrangement — other than the commission described above.

If any of that is not true in your case, delete it and say what is. A statement here that turns out to be inaccurate is far worse than no statement.
